Provincial garnishments

Provincial garnishments are issued when an employee’s creditor wins a judgement in small claims court or provincial/divisional court to garnish the employee’s wages to pay a debt. They cannot be issued directly by the creditor. The provincial government is responsible for tracking garnishments issued by small claims court.

Each province/territory has a law that indicates the percentage of the employee’s wages or a minimum amount that cannot be garnished. An employee cannot be dismissed because of a garnishment against their wages.
